Illustrations Terms of Service

This is the Terms of Service for Zurasuta during 2024, v1.1.

This document describes the rules and legally-binding terms of my service as an artist. Read it if you’re interested in requesting work from me or if you’re interested in understanding how my process works. Two main concepts are important to define first:1. The Commission: Your request to receive a Piece in exchange of money.
2. The Piece: One or more digital drawings or artworks in .png format, featuring one or more characters in a scenario provided by you.
Knowing that, my ToS is comprised of the following articles:Article 1. Commission Slots: Officially, one commission slot opens at 00:00 EST of the 1st of each month. A second slot opens during the 15th. These slots open regardless of whether I’m online or not, but I will most likely review them during the afternoon of such day. To request a commission, use the DM feature in Discord, Twitter or Facebook. When requesting a commission, send a brief description that I can use to form an idea of what you want, don’t wait for me to reply first. If I end up taking your commission, I will require a detailed summary with references for it, but this doesn’t have to be it. You can’t save a slot before it’s open.
•• Article 1.1. One additional irregular slot may open at my own discretion exclusively for Ko-Fi members, but only if there’s no slot open, nor there’s a commission currently in progress.
Article 2. Choosing Requests: If I receive more than one request for a given slot, I reserve the right to choose whichever request I prefer. Some of the criteria used are: Final price of the commission, personal interests, recurrent clientele and clarity of the request. If you get a slot, you can still apply to the next one but in the occurrence of getting multiple requests, variety of clients will also be considered a criteria.Article 3. Commission Summaries: Once I give you the slot and before taking your payment, I’ll need a summary with clear and colored visual references for the characters involved, their pose/expression, their clothing and (optionally) any details or information relevant to The Piece. If there are specific details on any character that you deem indispensable you have to let me know. If any of the characters doesn’t have a reference/sheet or artwork where I can clearly understand their design, you have to commission that design first, either to me or to another artist, but I won’t stage characters without concrete designs unless they’re Faceless Dummies (See Art. 16). Optionally, I welcome any mockup of The Piece if you’re willing and able to, even with stick figures.Article 4. Payment: Your commission must be paid in full before production, and I won’t start working on it until the payment has been fully processed, unless specifically agreed otherwise. The payment can be done via Paypal Invoice or Ko-Fi, but only once your commission has been accepted.Article 5. Pricing: The flat rate of any given commission is $100usd.Article 6. Discount: Currently, only Ko-Fi members, in the Silver Egg tier or above, have 10% discount on the final price of the commission.Article 7. Features: The base price for a commission guarantees one Main Character featured in any desired shot frame, using a flat-colored canvas, full colored, and rendered using cell shading. The quality of the line work is clean but not pristine, and the quality of the rendering may vary depending on the nature of The Piece. At minimum, every piece has three layers of shading on top of the base color.
•• Article 7.1. The base price does NOT guarantee: Any level of detail for a background, a one-to-one copy of every detail of any character, nor specific use of specific colors in specific parts of The Piece.
•• Article 7.2. The narrative of The Piece should inform the framing of the shot (See Art 14).
Article 8. Optional Base Features: These features are exclusionary of each other but are not mandatory. This is to say, you can choose one or neither without increasing the final price of the commission, as long as your commission complies with their specific conditions:
•• Article 8.1. A Secondary Character. This second character is colored and rendered in the same quality as the Main Character of The Piece, as long as: First, the scene or situation implies a direct interaction between both characters, and second, one of the character’s body is being occluded by the other character, their environment, or editorial artifacts (Such as: speech bubbles, frame cutting or direct omission). This is to say the presence of the secondary character in The Piece must be integral to its constitution and not an arbitrary addendum. This is the option you would choose if you just want an artwork of two characters doing something together.
•• Article 8.2. A Main Character’s Alternative Version. The Main Character’s clothing, expression, props and/or posing are different from an original version of The Piece, as long as: First, only two of the four features mentioned are subject to change, and second, the alternative version is similar enough to the original as to be able to utilize most of its layer information for the creation of the alternative. This is to say, the alternative version must be easily recognized as such instead of another brand-new drawing. This is the option you would choose if you want a set of .pngs (See Art. 12).
•• Article 8.3. A custom Character Design. To develop a full-body front-view reference for a brand-new character visual design, using either text or visual references or both, for a character that has not yet been drawn integrally in a character sheet, as long as: First, the character must be drawn in a neutral standard pose, either by T-posing or standing straight, and second, you must provide visual references for any detail you want the design to have in a specific way and text description for the rest. This is the option you would choose if you want a drawing of your tabletop RPG character.
Article 9. Additional Paid Features: These features are not exclusionary but do increase the final price of the commission and their values may change depending on the specificities of your commission:
•• Article 9.1. Extra Characters. Each extra character in the commission is $50usd, even if there isn’t a Secondary Character and their same conditions apply. This is to say, if you chose an Optional Base Feature that’s not Secondary Character, any additional character counts as an Extra Character, but they also have to be integral to The Piece. Multiple extra characters can be acquired. There might be situations in which the character’s design of the Extra Character is either too simple or too complex to justify the value of this charge, so it will depend on the specific case for your commission.
•• Article 9.2. Alternative versions by Characters. Each alternative version, by character is $25usd. The same rules of the Main Character’s Alternative Version apply. This is to say, a commission with two characters would still cost $100usd as per the Secondary Character optional base feature, adding an alternative version to one of the characters would cost $25usd, adding to a total of $125usd. Adding an alternative version to both characters would cost an additional $25usd adding up to a total of $150usd. Multiple alternative versions for the same character can be acquired. There might be situations in which occlusion of a character would make the changes on their alternative version too insignificant to apply this charge, so it will depend on the specific case for your commission.
Article 10. Revisions: There are three revisions. The first one happens after the rough draft (Or sketch) to make sure the direction of The Piece satisfies your vision. A second revision happens once the sketch is cleaned, with the final line-art ready, to corroborate no important details are missing. After this stage is approved you can't add things to the lineart of The Piece. The third revision happens once The Piece is finished and the changes made at this stage are only made on the color and shading layers. This follows a cascade workflow: Once a revision is approved I will go on with The Piece and I won't go back to previous stages in it. It's your responsibility to let me know about missing details or changes you want me to make on each revision. When asking for changes you must provide reference for them. Every revision is a single chance to spot mistakes or things you want to change, so use them wisely: You can ask for as many changes as you want, but it has to be at once, and only if they’re pertinent to the stage The Piece is already in. After I apply the changes requested I will automatically move onto the next stage.Article 11. License & Commercial Use: Commissions are licensed for personal use only, unless explicitly agreed otherwise. Commercial use will most likely be allowed for indie developers or content creators, on a case by case scenario. If you fall into those categories and you’re planning on using The Piece in a commercial fashion, you have to disclose it before The Commission gets accepted. If you already have a personal use-licensed Piece and want to make it commercial, you have to ask me beforehand and agree not to use it commercially if I don’t approve such use of The Piece.
Article 11.1. I keep commercial rights over any artwork I make, unless explicitly agreed otherwise. This is to say, although uncommon, I get to use The Piece in commercial projects such as prints, art courses, artbooks, etc.
Article 12. PNGTuber Characters: If your intention is to commission a set of .pngs for streaming, you will be provided with transparent backgrounds for the files in The Piece, but you have to let me know that amongst the details of The Commission in the first place, as some parts of production change when that’s the case.Article 13. Dimensions: The usable dimensions of the canvas I work with are 2000px by 2000px at 144dpi. This is a minimum, as sometimes The Piece’s final dimensions end up being considerably bigger. If your commission is for commercial use and you’re planning on printing, you must let me know in advance to adjust to your desired dimensions and resolution.Article 14. Level of Detail: Considering the dimensions described in the Art. 13, the size of my brush setting never goes below 10px. I do my best to keep a consistent level of detail across all pieces, so the price of the commission doesn’t change depending on the closeness of the shot being drawn (e.g. full-body, half-body, headshot), because the level of detail decreases or increases as the shot moves further or closer to the scene. However, this isn’t an exact science and doesn’t have accurate measures, because some characters are just simpler than others. For example: If your character is a Final Fantasy Au’Ra, the dimensions of the drawing will remain the same regardless of whether it’s a close-up to their face or a full-body drawing, but the level of detail will be greater in the close-up. If you character is a villager from Animal Crossing, it may benefit from being a full body, but the price for a close-up will still be the same even if the simplicity of their design dominate The Piece despite my efforts to stylize and add detail.Article 15. Background: If you have an idea for a simple background that can go well with the piece, be it abstract colors or patterns, feel free to include it on the Commission Summary. A basic-to-mid background feature will be added once I feel more comfortable with them.Article 16. Faceless Dummies: At my own discretion, The Piece can include one or more humanoid-representing figures, limbs, heads and other body parts drawn with a consistent amount of detail for the piece but focusing such detail into the relevant aspects of their expression for The Piece.Article 17. Speech Bubbles: The Piece may include speech bubbles or text as long as all the text is provided by you and approved by me.Article 18. Authorship: You must not take credit for the piece, alter the artwork, put filters on it, nor remove my signature from it. Cropping it for profile pictures is acceptable. Due credit must be given when possible. You won’t feed generative AI with The Piece nor agree to let someone or something else to do it. You won't use any stage of The Piece or other artwork by me to trace them in a commercial fashion.Article 19. Rough Drafts: During the Rough Draft of The Piece, or Sketch Stage, rejected or unused thumbnails (and silhouettes) might be saved and repurposed later for other commissions and/or YCH auctions.Article 20. Refunds: I reserve the right to make any refund, but notice: I have a public Trello board describing the status of each piece and/or project I’m currently working on, where each column represents a stage of production. The first stage of an artwork is called Setup. This is when I make the file for it, name it and put all of the references provided by you in it. I organize them either by moving, resizing or cutting, and make a collage with them. Once that’s done, I move the Trello item of the respective artwork from Setup to Gesture. In that moment, when I release the pression from the mouse after dragging the item and Trello registers the change, you lose any chance or right to a 100% refund.Article 21. Social Media: Once The Piece is done I will post it on social media, immediately or the day after, unless explicitly agreed otherwise. I reserve the right to tag you on it, but if you want or don't want me to tag you, you have to let me know in advance.Article 22. Referral: You can claim a free custom-made, non-animated Discord emoji, sticker or portrait when you refer a brand-new client, once their commission is done. A brand-new client is someone who hasn’t commissioned me ever before, proceeds to get a commission slot and follows through with payment. They have to tell me you refer them previous to their Trello item being made. You don’t need to have been a client or a member of my server to claim this gift, but if you’re neither, you need to be able to prove you’re not the same person as the brand-new-client, as this could be exploited otherwise. If I’m uncertain about this, I will refrain from making it. The same rules of the Commission Summaries apply (See Art. 3).Article 23. Content: I won’t draw suggestive affairs involving underage/seemingly underage characters, despite canonical facts; hateful or explicit political content, gore, extreme or non-consensual visual violence.
•• Article 23.1. Some of the content I would draw instead, that seems a bit unusual: Shortstacks, NTR, certain types of Mechas, certain types of Armour. If you’re unsure, it doesn’t hurt to ask.
By proceeding with a commission after reading these Terms of Service, you agree to abide to them.Note. If there’s anything about this ToS you don’t understand, or would like further explanation about, or examples, please write me explaining your concerns. I receive a lot of DMs and I usually dismiss the ones that are just “Hi”, so again, don’t wait for me to reply first.

AP's Cherubi Terms of Service

Cherubi are a semi-open species. This means anybody can make a one for their enjoyment. They are born with one or two skills depending on their backstory.You are allowed to create different versions of your Cherub as in other species, artstyles or as in different timelines. However, if you're using Alma Pulveris lore, you must stick to the Vocations your Cherub has. And you must give credit for the species when using an accurate version of the actual Cherub design or lore.You are allowed to use your Adult Cherub for any kind of roleplay. You are not allowed to use Young Cherubi for suggestive or erotic roleplay.You are allowed to make your Adult Cherub have children with other adult characters, whether they belong to Alma Pulveris or not, and have the children inherit the Novice skills from the main Vocation of your Adult Cherub. This applies to one generation only. The main Vocation of a character is the highest one developed or the one you prefer if there's a tie.You are allowed to sell or give away your cherub. If so, please refer the buyer to this ToS.On Vocations
As of today, there's 22 Vocations in total. Any Cherub can have all of them. Have in mind Vocations are not necessarily their professions or trades, they function as underlying classes that can overlap each other.
For a Cherub to learn a new Vocation you must first buy a Vocation Card, included within the Vocation Guides from my Ko-Fi Shop*. Consider Vocation Cards as MYO slots. A Vocation has three levels: Novice, Adept and Master. You are allowed to merge or split same-Vocation Cards to increase the level of the Vocation. 2 Novice cards make 1 Adept card and 2 Adept cards make a Master one. The level of a Vocation Card can also be increased through events on the Discord Server. Your Cherub gets new skills depending on the level of their Vocations and the sinergy between them.You are allowed to add new vocations to a Cherub, or transfer vocations from one Cherub to another, from the pool of Vocation Cards you own. To make an official change in the cards a character has there must be at least one artwork depicting the new state of the character for every character affected by the change.*: As of Jan 16th 2023, the Vocation guides are not available yet in the Ko-Fi Shop.On Canon
A formal adoptable cherub comes with a full-body full-color visual reference sheet, "Troika!" compatible* stats and it's added to the canonnical Records in the Discord server by default. This serves two purposes: One is to have a census of the Cherubi out there, and the other is for the characters to make cameos as extras in different media: Comics, games, zines. This is, granting recognition to the current owner in such pieces credits.
You are allowed to have your Cherub removed from the Cannonical Records at any point after the moment you get ownership of them.You are allowed to keep your Cherub in the Cannonical Records but opt out from having them appear as cameos in my work.You are allowed to make and change the backstory of your Cherub in any way that you prefer, whether that implies having it come or go to other narrative universes, keeping them or removing them from the Records.You are allowed to make changes to the aesthetics or visual appearance of your Cherub as long as the character preserves some kind of similarity to the original version. If so, the Cherub must be submitted for re-approval in the Registry.You are encouraged to invite a commissioned artist to the Discord server for the sake of making the commission and approval process easier for everyone.Failing to abide these Terms will have your character removed from the Records and yourself banned from the community.*: Alma Pulveris and Cherubi are both independent productions by Zurasuta and are not affiliated to the Melsonian Art Council.

Alma Pulveris Encyclopedia is a series of fantasy worldbuilding entries written both in english and asemic writing. The shown entries and the upper Sphynx illustration are the most pertinent for creature design.

Octoberries was a project of adoptable critters, based on a mixture of fruits and vegetables with cephalopods, to use as companions in tabletop roleplaying campaigns compatible with "Troika!".

A couple of design iterations on a commission using the Death Cap mushroom as the subject. In this specific case, the client didn't knew if they wanted an item or a character, so I made both.

Lay the Dice was a game jam project I made with my Discord server for the GMTK Game Jam 2022, I designed and coded its UI/UX alongside its chance-based gameplay, although the final assets you see in the video were made by a friend.

Gorun Gork was a science-fantasy MUD I made in college with a colleague. I designed and implemented most of the dynamic UI including inventory, equipment, quests and crafting system, alongside writing descriptions and dialogues for the rooms and characters.
